These Terms of Service (“Terms”) govern your access to and use of the website https://luxerates.com (the “Site”) and the mortgage brokerage services provided by LuxeRates, LLC (“LuxeRates,” “we,” “us,” or “our”). By accessing or using the Site, or by contacting us for mortgage-related services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

About Us

LuxeRates, LLC is a licensed mortgage broker (NMLS #2429343) that connects borrowers with third-party lenders. We are not a direct lender and do not originate or service loans ourselves. Our role is to shop your loan request among multiple lenders to help you find competitive rates and terms.

Eligibility and User Accounts

You must be at least 18 years old (or the age of majority in your state) to use the Site.
If you create an account or submit a mortgage application, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials.

User Submissions and Communications

When you submit an inquiry, application, documents, or any other information (including via phone, text, email, or the contact form), you grant us a non-exclusive, royalty-free license to use that information solely to provide the requested services and as described in our Privacy Policy.

SMS/Text Messages

By providing your phone number, you consent to receive text messages from us related to your mortgage inquiry, loan application, loan processing, appointment scheduling, document requests, account updates, and other customer service communications.
You may opt in to receive SMS messages from LuxeRates by submitting your phone number through a mortgage inquiry form on our website or providing verbal consent during a phone call after requesting mortgage information. By opting in, you confirm that you are the authorized user of the mobile number provided.
You can cancel the SMS service at any time. Just text “STOP” to 877-409-5893. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your interaction and loan activity. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
We respect your privacy. Your phone number and personal information will not be sold or shared with third parties for marketing purposes. If you have any questions regarding privacy, please read our Privacy Policy.

Intellectual Property

All content on the Site (text, graphics, logos, images, videos, etc.) is owned by LuxeRates or our licensors and is protected by U.S. copyright and trademark laws. You may not copy, modify, distribute, or commercially exploit any content without our prior written permission.

Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or to submit false or misleading information.
  • Attempt to gain unauthorized access to any part of the Site or our systems.
  • Interfere with the operation of the Site or transmit viruses or harmful code.
  • Scrape, crawl, or data-mine the Site.

We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUXERATES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you shall not exceed $100.

Indemnification

You agree to indemnify and hold LuxeRates harmless from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your submissions, or your use of the Site.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Suffolk County, New York.

Changes to These Terms

We may update these Terms at any time. The new Effective Date will be posted at the top. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
